MAY 19: VEA DELIVERED TO GOVERNOR (REPLY BY 2 JUNE 2016)


     It is great to see the veterans publicly supporting  this legislation. They will highlight that:

    1. The buyback is a modest and much- needed reform to an existing program

    2. No one who served defending the United States (and New York State) should be disadvantaged in the pension system.

    3. The existing law hopscotches arbitrarily between veterans who served in various countries and during  various dates.

  •      Excluded veterans  under the existing buyback program include some of our veterans  who served during  wartime and even excludes those who served in combat in Afghanistan, Somalia, and elsewhere.

  4. Women veterans  - by virtue of  odious and now-discredited and discarded statutes -  are particularly disadvantaged without this needed reform.

Call Governor Cuomo and Tell Him to Sign Veterans Equality Act
Dear Friend,

     We need your help to get the Veterans Equality Act signed into law. The bill is now on Governor Cuomo's desk. Cuomo has until May 31 to sign or veto the bill. He's vetoed it twice before, one time on the day before Veterans Day. He promised veterans that he would include the bill in this year's budget. That didn't happen, even though both the Democrat-led Assembly and the Republican-led Senate included it in their own budget proposals. Cuomo can fix that broken promise by signing the bill now.

     You can call Governor Cuomo at (518) 474-8390 and respectfully tell him to sign the Veterans Equality Act today and put all veterans on equal footing. Right now, for example, Iraq veterans are eligible to buyback up to three years of pension service credit for their time in the military, but Afghanistan veterans aren’t eligible. That makes no sense. All of the veterans this bill covers volunteered to serve in our armed forces and were willing to put themselves in harm's way for our country. Our state should treat them equally.
It would be great to have this bill become law this week as we head into the Memorial Day weekend. You can help make that happen.

  1. My sources tell me that there has been (an is ongoing) a back and forth discussion triggered by the passage of the bill. This is not uncommon in Albany. This was one intent of the passage (given the bill's double-veto and subsequent failure at budget time).

    For those focused on deadlines, it looks like 1 June or thereabouts is the deadline to hear from the Governor regarding the fate of the bill. Of course life and politics are full of exceptions and nuances.

    It goes without saying (I hope) that calls to the Governor's office ((518) 474-8390) must continue.

      Hopefully negotiations will be successful and the maximum number of veterans will be included in a signed bill( with changes ) on 6/1 !

      The 2000 compromise bill (1998 Bill 'full cost' negotiated down to the 3% discount) had the ugly, shameful and unannounced effect of throwing out some previously included (1998 Bill) wartime veterans.

      I don't believe previously included wartime veterans will now lose eligibility should there be a successful negotiation.

    3. That was unconscionable and I actually looked up what you are saying. Wow! Actually, less were covered under the 2000 law than under the 1998. That is backwards.

      Imagine if they pulled that crap and said, "from now on those who served in locations formerly recognized as eligible, such as Panama and Kuwait, are no longer eligible". That is going backwards.

      When you learn the past nonsense pulled it gives a certain perspective of our chances now.

    1. I'd guess country and not medal would be the criteria now. Too many non-combat expeditionary medals. That is the situation in Desert Storm - expeditionary medals mean nada for MSC.

  9. No more assumptions. No more negotiating with yourselves about what if's or whats a fair deal. The VEA is going to be vetoed. It's not going to be equality for ALL veterans. He is not a man of honor. He will give away the farm to a particular sect of people in exchange for huge voting blocks. That's why the NYPD, Mayor of NYC and the Gov administrations are all under investigation. And The Empire Policy Center has been and is currently pulling the strings here. Things have become too murky to figure out what's going on.

  10. The "Peacetime" veterans volunteered to serve with the commonly held belief that we would be going to war with the Soviet Union. Still they volunteered to serve with the knowledge that they would be "human speed bumps" in Fulda or targeted by the Soviet artillery and missile onslaught at any given point in time. To have the definition of a veteran be set by an individual who FAILED to put nation ahead of self is a travesty and frankly just sad.

  13. If hypothetically a compromise is struck, would the bill automatically become law or would it once again go through the legislative processession? (Both houses voting on it and the gov signing it before it becomes law)

    1. Agreed, as long as it is all Veterans! I think the 20 year minimum requirement satisfies the Mayor's gripe about a mass exodus. It ensure his first responders don't jump ship before twenty years if they want to purchase and since individuals are at different stages of hire it staggers it as well. It also ensure everyone pays the maximum but if they jump from a 20 year to a 23 year pension they may be tempted to do an additional two years for the full 25. My thoughts on it.

  15. If there is a compromise and Afghanistan/ Iraq combat veterans are allowed in the MSC program in exchange for a 20/30 back-end reform (20 for 20 year pension guys and 30 for 30 year pension guys) I don't think that can be done via chapter amendment.

    Probably an announcement to that effect as part of the veto message and then a new bill signed prior to the end of this session.

    1. He has until June 1st I believe to sign or veto (10 days from delivery). If he does nothing which will NOT happen it would automatically go through. At this time, legislators are still in session and actively voting until mid-June.

  21. If you know that our wars over the last hundred years have been covered via military service credit and you take a look at the 2000 Law, the absence of OIF and OEF jumps out at you. The fact that a few tiny conflicts are even listed, makes the absence of OIF (theater)and OEF (theater)even more - if possible - glaring.

    Doesn't take much to realize OIF and OEF combat veterans (wounded and otherwise) will move into the updated program if any agreement at all is reached.

    That's all I am willing to predict should an agreement be reached.

    2. Operation Iraqi freedom, operation enduring freedom, (afganastan). OIF is already included based on the language of the law of 2000. Afghanistan is not, I don't understand why VSE says OIF will be included in the new law. When as I understand it already is.

    3. Iraq itself is already included. OIF (Iraq plus theatre including Turkey, Jordan, waterways, airspace, etc. is not. )

      OEF (AFG plus theatre) is not. Theater for AFG would include Uzbek, Pak, waters, airspace, etc.

      Both OIF and OEF were after the 2000 law.

      Close to 3 million servicemen and women have served in OIF/OEF with 60k casualties.

      I hope every veteran knows the terms OIF and OEF.

    3. His staff is preparing his veto message and he may or may not know anything about the pending bill or pending deadline. His staff manages that sort of thing.

      His staff will also prepare a document of possible options on MSC going forward based on discussions/negotiations w/veterans reps. Which he may or may not read. Which may or may not be integrated into a veto message or future joint message (again).

      Deadline is approaching (the days flex a bit but his staff knows what they consider the deadline).

    The whole idea was to spur a negotiation of some sort to get SOME vets into the program.

      Changing the approach to smaller bills next year to spur negotiation or to achieve direct MSC for wartime vets shows a smart application of lessons learned.

  27. LOL - you guys are great! good memories of the doom-n-gloom 'barracks attorneys' who used to sit around and talk about how we had just been, were currently getting, or were about to be, screwed over somehow. entertaining - and maybe true - but it got old after awhile.

    Simple fact is: life ain't fair and equitable. A lesson I learned in grade school. The Marines took me to over 18 countries in the Middle East, Europe, Africa, and Asia. Cuomo doesn't think I rate a buyback? I laugh at him too. I didn't join up thinking I would reap some back-end benefit 25 years later at a state job I never knew I was going to get anyway. Sure, it would have been nice - but one has nothing to do with the other. It would be a benefit but it certainly isn't an entitlement. I'm still a little confused as to how I got PFC out of boot camp over guys who were better shooters and more physically fit than I was simply because I had some college credits. Of course, and as I told them, life ain't fair... buck up.

    1. Life sure isn't fair but the law has to be fair and equitable, especially when it concerns access to funding for programs that benefit one group over another. That being said, when a representative legislative body creates said programs and signed into law by the governor, then the government has satisfied it's requirements of fair and equitable treatment. The MSC law is not fair or equitable but it has been the standard for decades.

    2. Some folks whine about the Tier system here in NYS as "Unfair" "Inequitable" etc. Because it is based on year of service. Always will be whiners out there.

      There a million other examples and MSC law here in NYS (and other states) is within that million other examples.

      A couple of peace timers hope the fact that two people are veterans make them similar in the eyes of all state law. Not the case. Or that two people who are employees of the very same state entity must be similarly situated for Tier determination. Again, wrong.

  31. It's that time again gentlemen. Here we are again poised to hear our fate. Many are negative and many are positive. This is what makes us human. Patence is getting thin,relax it'll be here shortly. All I have to say since this time around I stayed mostly guiet . It's been one hell of a ride watching the separation of arms! Men arguing over things that should or shouldn't be in VEA. I've been with a municipality for 28 years never once thinking that a law like this would ever change. Knowing all about the past law it didn't bother me. Knowing I'm doing 30 years of service to earn my 60% pension . I have been with this blog since the beginning and now I say thank you again VSE for this blog . What happens ...happens, 2 years to go is fine anything else I receive is a given . A Veteran is a Veteran.......you are playing into cuomo's hands......why pass a bill that even all veterans can't agree on.....a Veteran is Veteran......you are familiar with divide and conquer....Cuomo is using that tactic......once you divide you lose your strength and expose your weakness.......I respect and praise ALL VETERANS......I do not ask for a copy of their DD214......

      Please do not compare NY to other states. In the first case you are completely wrong. NJ, for example allows 10 years of purchase for former military and an additional 5 years for those who are considered veterans. "Veterans" in NJ are only those who have served in wartime: http://www.state.nj.us/treasury/pensions/pdf/factsheets/fact17.pdf


      In the second case "full cost" v a 3% discount here in NY makes any comparison self defeating. Unless you want 'full cost'. I have continuously warned about comparisons to other states.

  35. If wartime folks don't get in to the wartime program they should focus and back a wartime veterans bill to enter the wartime program.

    If peacetimers don't get into the wartime program, they should back a bill setting up a Cold War MSC program. Just like the Cold War folks did after failing to gain membership in the wartime property tax exemption program. In retrospect that was a no-brainer move for the Cold War veterans (since they weren't wartime and of course did not belong in a wartime program) and they are kicking themselves for not trying sooner.

  38. VSE, I see the title above was changed to include an answer by June 2nd. Is that 2400 hrs June 1st or 2nd. It was my understanding that it was 10 days from date of delivery.
    Delivered on may 19 + 10 = may 29th + 2 Sundays = may 31 + 1 holiday = June 1st. Are the excluding may 19, and start may 20th? That would account for it to be june 2nd. It's a bit confusing.

    3. The Gov. vetoed the VEA with 30 minutes left on the clock last year !
      I have not seen anything in writing that holidays do not count as part of the 10 days . If there is no veto by midnight tonight can we tell the press that the VEA pocket passed ?

  39. While the Legislature is in session, the Governor has 10 days (not counting Sundays) to sign or veto bills passed by both houses. Signed bills become law; vetoed bills do not. However, the Governor's failure to sign or veto a bill within the 10-day period means that it becomes law automatically. Vetoed bills are returned to the house that first passed them, together with a statement of the reason for their disapproval. A vetoed bill can become law if two-thirds of the members of each house vote to override the Governor's veto.

      For a more complete understanding, verbatim, check the link below (refer to section 7).
      Note:
      1) The use of the word "SHALL" indicates not an option, but in fact a mandate.
      2) the language "(excepting Sundays)" (no mention of holidays).

  42. There is some confusion between the terms "in session" and "end of the legislative calendar" (which is June 16 of this year).
    As we learned in the past, the legislature is almost always "in session", well beyond the "end of the legislative calendar".
    The confusion between the two allowed us to be bullshitted by the legislators who had voted for the VEA, and claimed that it should be overridden, but it was nearly impossible, because they were "NOT in session", and it would require that a "special session of the legislature" be convened (which is virtually impossible). Twice.
    This was a bold-faced lie. Twice told.
    Otherwise, we would not have been looking at 10 day window awaiting action on the VEA, in either 2014 or 2015, as opposed to a 30 day window, which in either of those years, would have allowed Cuomo to comfortably wait until after Veterans Day either year.
    Let's see what kind of excuses they make this year
